Q: does a fan in the bathroom have to be vented out the roof or in the attic because they have it vented to the attic

A: Proper ventilation keeps a house dry
It should vent out side the house. if it only vents into the attic you are in danger of mold due to moisture from shower exhaust. It is good to vent out a side wall or a soffit area under an eave.
These are a coulple of options if you don't want to penetrate the roof with a vent.

Bathroom vent fans should always be vented out the roof, or directly out the wall if the roof is not a possible option.
Venting a fan into the attic traps all the air, odors, etc the fan is designed to remove. This can lead to mold growth on the underside of the roof decking and on roof rafters and ceiling joists.
